NightUp is a marketplace platform. Vendors control their venues and entry policies.
Payments are processed by Stripe. We generally receive limited payment signals (e.g., payment status), not full card numbers.
We share limited information with Vendors for fulfillment (e.g., your name and booking details).
We use information to operate the Platform, support users, prevent fraud, and enforce our Terms.
We retain certain records for at least five (5) years for fraud prevention, chargebacks, disputes, compliance, and legitimate business needs.
Scope & Important Notes
1.1 What This Policy Covers
This Privacy Policy applies to information we collect:
- Through the Platform
- Through support channels (including in-app chat and email)
- In connection with Bookings, payments, disputes, and fraud prevention
- Through marketing and analytics activities associated with the Platform
1.2 What This Policy Does Not Cover
- Vendors and their independent practices
- Third party websites or apps linked from the Platform
- App store providers (Apple, Google) and their practices
- Payment Processor and other service providers acting as independent controllers
1.3 Vendors Are Independent Third Parties
NightUp helps you discover and book nightlife-related experiences offered by independent Vendors. Vendors may collect information from you directly at entry or on site. Vendor collection is governed by Vendor policies, not this Privacy Policy.
1.4 Changes to This Privacy Policy
We may update this Privacy Policy from time to time. The updated version will be effective when posted unless we specify otherwise. If changes are material, we may provide additional notice as required by law.
Information We Collect
We collect information in three primary ways: (a) information you provide, (b) information collected automatically, and (c) information from third parties.

- Support requests, attachments, and information during support interactions
- Where permitted by law, recordings or transcripts of support communications and related metadata (e.g., timestamps)
D. User-Generated Content (if enabled)
- Photos, videos, reviews, ratings, comments, and other content you post
- Content you share in messages or chats through the Platform
E. Verification & Security Information (limited)
- We may request limited information to verify account security or investigate suspected fraud
- Our Payment Processor or verification partners may collect additional information directly from you under their own policies

- Device type, model, and operating system
- App version and settings; browser type (if using a web experience)
- IP address
- Device identifiers and advertising identifiers (as permitted by your device settings)
- Language and time zone settings

- Screens or pages viewed
- Actions taken (searches, clicks, favorites, bookings initiated, checkout started or completed)
- Session information, timestamps, and logs
- Crash reports, diagnostics, and performance metrics
C. Approximate Location Information
- We may infer approximate location from your IP address
- If you enable location permissions, we may collect device-based location to improve functionality (e.g., showing nearby venues or events)
D. Cookies, SDKs & Similar Technologies
- When you use web-based components (and in certain in-app contexts), we may use cookies, SDKs, pixels, and similar tools to operate the Platform, remember preferences, measure performance, and help prevent fraud

How We Use Information
- Operate the Platform: Create accounts, facilitate bookings, process payments, provide search and discovery
- Customer support: Respond to inquiries, send booking confirmations and reminders, OTP verification
- Safety & fraud prevention: Detect fraud, abuse, unauthorized access, and chargeback abuse
- Improve the Platform: Monitor performance, analytics, testing, product development
- Marketing: Send marketing emails and push notifications subject to your preferences
- Legal & compliance: Comply with applicable law, maintain records for audits and dispute handling
How We Disclose Information
4.1 Disclosures to Vendors
To facilitate a Booking, we may disclose your name and booking details (event/venue, date/time, ticket/table/package details, confirmation status) to the Vendor.

- To protect rights, safety, and security of NightUp, users, and Vendors

4.5 Disclosures with Your Direction or Consent
We may disclose information when you direct us to, or when you consent to disclosure.
4.6 Advertising & Analytics
NightUp may use analytics and measurement tools. If we engage in targeted advertising in a way that may constitute a "sale" or "sharing" under U.S. state laws, you may opt out as described in Section 7.
Cookies, SDKs & Similar Technologies
We use these technologies to keep you logged in, remember preferences, measure performance, attribute campaigns, prevent fraud, and understand user interactions.
5.2 Your Controls
- Browser cookie settings may allow you to block or delete cookies
- Mobile OS settings allow limiting ad tracking or resetting advertising identifiers
- Disabling certain technologies may affect Platform functionality
5.3 Do Not Track & GPC
Where required by applicable law and technically feasible, we will honor signals such as the Global Privacy Control (GPC) for web-based experiences.
Data Retention
We generally retain account, booking, transaction, communications, and related records for at least five (5) years, and longer if required by law or reasonably necessary for fraud prevention, chargeback handling, dispute resolution, or legal compliance.
- Account records: Active period + at least 5 years
- Booking & transaction records: At least 5 years
- Support & communications: At least 5 years where relevant to disputes
- Logs & security events: At least 12 months, up to 5 years
- Marketing preferences: Until you change preferences or request deletion
Your Privacy Rights & Choices
7.1 Account Information
You may review and update certain account information through the Platform. You are responsible for keeping your contact information accurate.
7.2 Marketing Communications
- Email: Opt out of marketing emails using the unsubscribe link
- Push notifications: Disable through your device settings
- SMS: If we send marketing texts, you will be able to opt out as required by law. Transactional texts (e.g., OTP and booking confirmations) may still be sent where permitted
7.3 Location Permissions
You can control location permissions through your device settings.
7.4 U.S. State Privacy Rights
- Access to certain personal information
- Correction of inaccurate information
- Deletion of certain personal information
- Opt out of certain processing, including "sale" or "sharing" for cross-context behavioral advertising
7.5 How to Submit a Privacy Request
7.7 Response Timelines
We respond within the timeframes required by applicable law. Where an appeals process is required, we will provide instructions for appealing a denial.
7.6 Verification & Authorized Agents
To protect you and prevent fraud, we may need to verify your identity before processing requests. Verification may require matching information you provide with information we have on file. If you use an authorized agent, we may require proof of authorization and may still verify your identity directly.

We will not unlawfully discriminate against you for exercising privacy rights.

NightUp does not sell personal information for money. To opt out of certain advertising practices, email privacy@nightup.vip with subject "Do Not Sell or Share".
8.4 Sensitive Personal Information
NightUp does not intentionally collect sensitive personal information as a core part of the user experience. Vendors may check government-issued IDs at entry, and payment processors may collect identity information for verification.
International Users
NightUp is based in the United States. Information we collect may be processed and stored in the United States and other locations where our service providers operate.
If NightUp offers services to users in the EEA, Switzerland, or the United Kingdom, additional disclosures and rights may apply, including legal bases for processing and cross-border transfer safeguards.
Security
We maintain administrative, technical, and physical safeguards designed to protect information. No security measures are perfect, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials.
Children's Privacy
The Platform is not directed to children under 18, and we do not knowingly collect personal information from children under 18. If you believe a child has provided personal information to us, contact privacy@nightup.vip.
